These Terms of Service ("Terms") govern your use of LUMYN. LUMYN is operated by Quis Kemono Labs ("LUMYN", "we", "us"). Please read them carefully — by using LUMYN you agree to them.

1. Acceptance & eligibility

By creating an account or using LUMYN, you confirm that you meet the age requirements below and that you agree to these Terms and to our Privacy Policy. If you do not agree, do not use LUMYN.

LUMYN offers two ways to run its AI models, and they have different age requirements:

  • Cloud models — 13 and up. LUMYN's cloud option runs on mainstream, professionally moderated AI models with their providers' safety systems in place. You must be at least 13 years old to use LUMYN at all, and if you are under 18 you may use the cloud models only with a parent or guardian's knowledge and consent.
  • Local (self-hosted) models — strictly 18+. LUMYN's local option runs unrestricted AI models on your own computer. These models do not have the content safeguards of the cloud models and are not suitable for minors. You must be at least 18 years old to download, set up, or use LUMYN with local models.
Honesty note on enforcement. We rely on your representation of your age — LUMYN does not currently run identity or age verification. If you are a parent or guardian and believe a minor is using the local models, contact us and we will help. Any future age-appropriate offering for children or schools (for example, a "LUMYN for Education") would be a separate product with its own child-safety design, parental and school consent, and its own terms — it is not offered under, or covered by, these Terms.

2. What LUMYN is

LUMYN is an AI companion: software that holds a persistent persona and memory so it can converse with you over time. LUMYN is a computer program, not a human being, and is not a licensed professional of any kind. Its "companion" and "soul-bound" nature describe a product experience, not a legal, medical, or fiduciary relationship.

3. AI output & not professional advice

LUMYN's responses are generated by AI and may be inaccurate, incomplete, outdated, or offensive. Some LUMYN models are uncensored ("abliterated") and will not refuse or filter content the way mainstream assistants do. You are responsible for how you use what LUMYN produces.

LUMYN does not provide medical, legal, financial, psychological, or other professional advice, and nothing it says should be relied on as such. Always consult a qualified professional for those matters. LUMYN is not a crisis service. If you are in danger or experiencing a mental-health emergency, contact your local emergency number or a crisis hotline immediately.

4. Your account

  • You are responsible for activity under your account and for keeping your passkeys and recovery codes safe.
  • Recovery codes are shown once and stored only in non-reversible form — if you lose your passkeys and your codes, we may be unable to restore access.
  • Don't share your account or impersonate anyone else.

5. Acceptable use

You agree not to use LUMYN to:

  • Break the law, or generate or distribute illegal content (including any sexual content involving minors — which is strictly prohibited and will be reported).
  • Harass, threaten, defraud, or harm other people.
  • Attack, overload, reverse-engineer, or circumvent the security or usage limits of the service.
  • Misuse the security tools. LUMYN's Pro/Max security ("SecOps") features may be used only against systems you own or are explicitly authorized in writing to test. Using them against any other system is prohibited and may be illegal — you are solely responsible for having authorization.

We may suspend or terminate accounts that violate this section.

6. Local install & third-party software

LUMYN's local mode requires you to install third-party software (such as Ollama) and AI models on your own hardware. That software is governed by its own licenses, and the AI models by theirs. You are responsible for your own device, its security, and ensuring it meets the requirements. Performance depends on your hardware, and low-spec machines may be slow or unsupported.

7. Subscriptions, billing & refunds

  • LUMYN offers a Free tier and paid Pro ($15/month) and Max ($30/month) subscriptions, plus optional one-time usage top-ups. Prices are in USD and exclude any applicable tax.
  • Paid plans auto-renew monthly until cancelled. By subscribing you authorize us, through Stripe, to charge your payment method each period.
  • Cancel anytime in Settings → Billing. Cancellation takes effect at the end of the current paid period; you keep access until then.
  • Except where required by law, payments are non-refundable, and top-up balances are non-refundable and non-transferable. We may consider refunds at our discretion on a case-by-case basis — contact [email protected].
  • We may change prices or plan features with reasonable advance notice; changes apply to the next billing period.

8. Your content & memory

You own the content you provide and the memory your LUMYN builds with you. You grant us only the limited license needed to store, process, and transmit it in order to operate LUMYN for you. You can export or permanently delete your data at any time from Settings → Privacy. You are responsible for the content you submit and confirm you have the right to submit it.

9. Intellectual property

LUMYN — including its name, persona, interface, branding, and original code — is owned by the Operator and protected by intellectual-property law. We grant you a personal, non-exclusive, non-transferable, revocable license to use LUMYN under these Terms. The underlying open-source AI models remain under their respective licenses.

10. Availability & "as is"

LUMYN is offered as an evolving, early-stage service. We may add, change, suspend, or discontinue features at any time, and we don't guarantee uninterrupted availability.

LUMYN is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that LUMYN will be error-free, secure, or that its output will be accurate.

11. Limitation of liability

To the maximum extent permitted by law, LUMYN and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) LUMYN. Our total liability for any claim relating to LUMYN will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD $100.

12. Indemnification

You agree to indemnify and hold harmless the Operator from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of LUMYN, your content, or your violation of these Terms or of any law or third-party right.

13. Termination

You may stop using LUMYN and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the service or other users. Sections that by their nature should survive (ownership, disclaimers, liability limits, indemnification, governing law) survive termination.

14. Changes to these terms

We may update these Terms as LUMYN evolves. When changes are material we'll update the date above and, where appropriate, notify you in the app. Continuing to use LUMYN after an update means you accept the revised Terms.

15. Governing law & disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-laws rules, and any dispute will be resolved in the state and federal courts located in the Commonwealth of Massachusetts, unless applicable law gives you a non-waivable right to another forum.
